TERMS AND CONDITIONS

Please see the below terms and conditions subject to which we (Belle & Beau Events) allow you (the hirer) to hire our equipment (including all items that we offer for hire). By signing this document, you are agreeing to pay any costs related to the hire or sale (as stipulated in the

quote) of our products/equipment, and you are consenting to these terms and conditions.

1. Use of hire equipment

1.1 Hire props/equipment should only be used as agreed by us (Belle & Beau Events) and you (the hirer).

1.2 When the Terms & Conditions contract is prepared and signed, certain payments will need to be made in advance such as an initial deposit of 20% to confirm the contract, 50% three months prior to the event and 100% payment two weeks prior to the event. Further to this a security deposit is required at least two weeks prior to the event, the amount as agreed within the contract.

1.3 Until the Terms & Conditions are signed and the 20% deposit is made, neither Belle & Beau Events or the hirer are bound by any contract, this includes any quotes provided or discussions/negotiations held in the lead up to the contract being completed.

1.4 Some props/equipment are required to be set up by Belle & Beau Event staff to ensure that it is safe for use. Once props/equipment are set up, they should not be changed by anyone, until our staff return to collect the items.

1.5 Any damage that occurs to props/equipment will be the liability of the hirer and will need to be replaced at cost price as determined by Belle & Beau Events. If props/equipment are damaged or stolen by an unknown person (not part of the event), the police should be called, and a formal statement given by the hirer.

1.6 Once the props/equipment are in the possession of the hirer, steps should be undertaken to ensure that there is no injury to the hirer or other persons attending the event. Belle & Beau Events will not take responsibility should injury occur due to negligence of the hirer.

 

 

2. Delivery and pick-up

2.1 Delivery and pick-up will occur during a window agreed to by both Belle & Beau Events and the hirer. Belle & Beau Events will make themselves available during this window for both pick- up and delivery times. If the hirer does not pick-up items, or is not available during the delivery or pick-up window, additional fees may apply, depending on the impact on our staff (this may include fees to cover their pay rates and/or fees if re-delivery is required).

2.2 Delivery within 10km of the Belle & Beau Events storage unit is free, not including large items (such as large quantities of chairs, tables or arbours). Anything outside this area will be negotiated between Belle & Beau Events and the hirer.

2.3 The hirer will have the option of picking up props/equipment from a storage location within the Hawkesbury area and further details will be provided when preparing the contract, as noted above, not all items are suitable for pick up, such as arbours/backdrops that require assistance when setting up.

 

 

3. Cancellation fees and security deposit:

3.1 As noted above, a 20% deposit is required to confirm your order. If you cancel your event more than six months out, your deposit will be refunded in full, less any fees required to cover costs of the preparation of your contract and any other work completed by the Belle & Beau

Events staff.

3.2 If you cancel your event more than three months out, you will receive 10% of your deposit back.

3.3 If you cancel less than three months out, you will not receive a refund of your deposit, however, will not be required to make the full payment.

3.4 If you experience financial hardship in the lead up to your event and are unable to make payments as needed, please contact us and we can attempt to make a payment plan to assist you, however depending on the amounts owing, this may not always be viable.

3.5 Further to clause 3.4 we understand that during the COVID-19 pandemic or due to unforeseen circumstances, your events may not always go to plan. If this is the case, please discuss it with us and we may be able to come to an agreement to modify or cancel the contract, with the least amount of burden on you, as noted above, depending on the amount of work put it in by Belle & Beau Events staff, timeframes or amounts owing, this may not always be viable.

3.6 As noted above in clause 1.3, a security deposit is required two weeks prior to the event date. Once props/equipment have been returned and there is no evidence of missing or damaged items, the security deposit will be refunded.

3.7 If there is evidence of damage to equipment or items are missing and the security deposit does not cover the damage, it will be the hirer’s responsibility to cover costs, whether the

equipment was directly damaged by them, as noted in clause 1.5.

 

 

4. Limitation of liability

4.1 Belle & Beau Events will provide a duty of care and when setting up props/equipment to ensure that the risk of harm is minimised and that the hirer and people attending the event are safe.

4.2 Once Belle & Beau Events staff leave the site/venue, it is the hirer’s responsibility to ensure that props/equipment that is required to be set up by staff (as stipulated in the Terms & Conditions) that have been set up are not moved or changed.

4.3 Once the equipment is in the possession of the hirer, Belle & Beau Events will not be liable for any damage that is caused by the equipment to the venue or any other products at the event.

4.4 Failure to comply with this agreement by Belle & Beau Event’s, that is out of our reasonable control (e.g. Extreme weather conditions or natural disaster), will not render us liable for loss to the hirer or third party.
